Terms of Service

This document describes how Qalith works: what we build, what we operate, what we charge for, and what we answer for when something goes wrong. It is written to be read before hiring, not after an argument.
1. Who we are and what this covers
Qalith is a development studio based in Santiago, Chile. These terms apply to every service in section 2 and take effect when you place an order or accept a proposal. If you disagree with any part of them, do not hire us — that is the honest outcome for both sides.
2. What we sell
Web and application projects. Landing pages, multi-page sites, e-commerce, and taking a project that already exists the rest of the way to production. Scope and price are set per project, in a written proposal.
Game servers. Monthly rental on our own Pterodactyl infrastructure. Today that means Minecraft and Left 4 Dead 2; any other game is a conversation, not a catalogue item.
Monthly support. A standing agreement to maintain and attend to something already running, whether or not we built it.
We do not sell VPS, shared hosting, reseller plans, or scripts. If we ever do, it will say so here first.
3. Web and application projects
Every project starts with a written proposal: scope, deliverables, price, and timeline. What is not in the proposal is not in the project — additions are quoted separately rather than absorbed in silence, which is how a fixed price stays fixed.
Billing is 50% to start and 50% on delivery, unless the proposal sets different milestones. The timeline assumes you supply content, access, and decisions within the agreed windows; time spent waiting on those moves the delivery date by the same amount.
On final payment, the delivered code and design are yours. Third-party licences — themes, fonts, plugins, APIs — keep their own terms, and any recurring cost among them is yours to carry. We keep the right to describe the work publicly and show it in our portfolio, unless the proposal says otherwise.
4. Game servers
Servers are billed monthly in advance and ship with the base Pterodactyl egg for the game. Configuration — modes, mods, maps, plugins, anti-cheat — is yours, unless you hire us to do it.
Resources are shared. Several services live on one node. A service consuming enough CPU, memory, or disk I/O to degrade the others will be limited, and we will tell you when that happens.
Keep your own backups. We do not offer a customer-facing backup product, and we do not guarantee that any copy of your server content can be restored. Whatever you cannot afford to lose, download and keep yourself.
5. Payments
Billing runs on Paymenter, at pay.qalith.com, with whichever gateway is enabled at checkout. Your invoices, your services, and your account live there.
Prices are in US dollars unless a proposal says otherwise. Payment processor fees are not ours to give back: the processor has already taken them.
6. Non-payment
An unpaid renewal suspends the service: it stops running, and its data stays in place while the invoice is outstanding. A service that stays unpaid is eventually terminated along with its data. We notify by email before reaching that point whenever we can — but see section 4 and keep your own copy.
7. Acceptable use
- Nothing illegal in Chile or where you are.
- No attacks launched from our infrastructure — DDoS, port scanning, intrusion attempts.
- No pirated content, malware, or phishing.
- Mods, plugins, and add-ons you install are yours. Copyright complaints about what you upload are answered by you, not by us.
- You are responsible for the terms of service of the game you host — Mojang, Valve, and whoever else applies.
8. Availability
We do not sell an uptime guarantee and we do not publish an SLA. We run the infrastructure, we watch it, and we fix what breaks as fast as we can — and we would rather say that plainly than print a number we cannot enforce against a datacenter, an ISP, or Cloudflare. Planned maintenance is announced in advance whenever it is planned.
DDoS mitigation is not a feature of these services.
9. Suspension and termination
We may suspend or end a service for non-payment, for a breach of section 7, on a valid legal order, or when resource abuse is affecting other customers. You may cancel a monthly service at any time from Paymenter; it runs until the end of the period already paid for.
10. Liability
Our total liability for any claim is capped at what you paid us for that service over the previous 30 days. We are not liable for lost profit, indirect damages, loss of data, or anything caused by software you installed.
11. Your data
Personal data is handled as described in our Privacy Policy. Refunds are covered by the Refund Policy. Both form part of these terms.
12. Changes
We may update these terms. The date at the top is the one that counts, and a change affecting an active service is emailed to you 14 days before it applies.
13. Governing law
Chilean law governs these terms, and the courts of Santiago hear any dispute.
